Terms, Conditions & Operational Policy

Effective Date: July 2026 By booking, purchasing, checking the agreement box, or requesting services from KC Pet Search & Rescue LLC / KC Pet Search & Rescue, you (“Client”) acknowledge, understand, and agree to the following terms, conditions, cancellation policy, refund policy, and operational policies.

1. Nature of Service — No Guarantee of Recovery

KC Pet Search & Rescue provides search, location, tracking, trapping, drone, thermal imaging, and recovery assistance for lost pets and related animal recovery situations.
  • Recovery is not guaranteed.
  • Outcomes depend on animal behavior, weather, terrain, timing, visibility, property access, owner participation, third-party actions, and other conditions outside our control.
  • Payment is for deployment, time, expertise, equipment use, operational planning, travel, and resources — not for a guaranteed recovery result.
  • A successful sighting, detection, containment attempt, or recovery effort does not guarantee physical capture or return of the animal.

2. Cancellation Policy — Non-Refundable Retained Amounts

Due to the immediate, time-sensitive, and resource-intensive nature of lost pet recovery work, certain amounts become non-refundable once work begins.
  • $30 is non-refundable and retained once consultation, communication, case review, scheduling, coordination, or recovery strategy has begun.
  • $100 is non-refundable and retained once deployment preparation, travel, arrival, field response, on-site operations, equipment staging, drone preparation, trapping preparation, or active field work has begun.
These retained amounts are not penalties. They reflect real operational time, preparation, scheduling impact, equipment readiness, case management, travel commitment, and the loss of availability for other urgent calls. By booking, purchasing, or checking the agreement box at checkout, Client acknowledges and accepts these non-refundable retained amounts.

3. Refund Policy

Refund eligibility depends on how far the case has progressed at the time of cancellation.
  • If Client cancels before any consultation, communication, scheduling, planning, or case strategy begins, a refund may be issued at our discretion.
  • If consultation, communication, scheduling, or case strategy has begun, $100 is retained and non-refundable.
  • If deployment preparation, travel, arrival, or field operations have begun, $200 is retained and non-refundable.
  • Once on-site operations, drone deployment, thermal scan, trapping work, active search work, or field response has occurred, the service is considered substantially performed and refunds are generally not available.
  • Refunds are not provided because the animal is not recovered, not seen, moves locations, returns home before or during operations, is recovered by another party, or because conditions limit effectiveness.
Any approved refund will be reduced by the applicable non-refundable retained amount and any payment processing fees that are not returned by the payment processor.

4. Emergency & Priority Deployment

Emergency and priority services are intended for recent escapes, active sightings, urgent recovery situations, or time-sensitive cases.
  • Deployment timing is not guaranteed to be immediate.
  • Priority cases are scheduled based on availability, safety, weather, daylight/night conditions, airspace, location, equipment readiness, and logistics.
  • By booking a priority or emergency service, Client is securing placement in the active deployment queue, not a guaranteed arrival time or guaranteed result.

5. Safety & Right to Refuse, Delay, Modify, or Terminate Service

KC Pet Search & Rescue LLC / KC Pet Search & Rescue reserves the right to delay, modify, refuse, cancel, or terminate operations at any time due to safety, legal, operational, environmental, or animal behavior concerns. Reasons may include, but are not limited to:
  • Unsafe weather or poor visibility
  • Rain, lightning, high winds, extreme temperatures, or unsafe flight conditions
  • Airspace restrictions, FAA limitations, or temporary flight restrictions
  • Unsafe terrain, traffic, water hazards, wooded areas, or restricted locations
  • Aggressive, unpredictable, injured, or highly stressed animal behavior
  • Lack of property access or permission
  • Client, bystander, or third-party conduct that creates safety concerns
No guarantee is made that operations will continue once safety or legal thresholds are reached.

6. Animal Behavior & Risk Acknowledgment

Client understands that lost animals may behave unpredictably. Even friendly pets may flee, hide, panic, bite, become defensive, cross roads, enter unsafe areas, or relocate during a recovery attempt.
  • Use of drones, thermal equipment, traps, bait, cameras, human presence, owner calls, lights, vehicles, or search activity may influence animal behavior.
  • KC Pet Search & Rescue LLC / KC Pet Search & Rescue does not guarantee that an animal will remain in one area, approach a trap, respond to the owner, or allow capture.
  • Client assumes the inherent risks involved with lost animal search and recovery work.
KC Pet Search & Rescue LLC / KC Pet Search & Rescue is not responsible for:
  • Injury to the animal
  • Escape, relocation, or failure to capture the animal
  • Behavioral outcomes before, during, or after deployment
  • Actions taken by neighbors, volunteers, shelters, animal control, police, property owners, or other third parties

7. Injury & Liability Waiver

Client agrees that KC Pet Search & Rescue LLC / KC Pet Search & Rescue is not liable for injuries, damages, losses, or claims involving:
  • The animal
  • The Client
  • Family members, helpers, volunteers, neighbors, bystanders, or third parties
  • Property, vehicles, gates, fences, yards, traps, cameras, or equipment not owned by KC Pet Search & Rescue LLC
Client assumes all risk associated with animal recovery efforts, including wildlife interaction, domestic animal behavior, environmental hazards, nighttime activity, weather, terrain, and property access.

8. No Liability for Illness, Injury, or Death of Animal

Under no circumstances shall KC Pet Search & Rescue LLC / KC Pet Search & Rescue be held responsible for illness, injury, disappearance, relocation, worsening condition, or death of the animal, whether occurring before, during, or after deployment. Lost pet recovery involves unpredictable circumstances and does not transfer care, custody, ownership, or control of the animal to KC Pet Search & Rescue LLC / KC Pet Search & Rescue.

9. Access & Property Conditions

Client is responsible for providing accurate information and obtaining property access when needed.
  • Client must provide the most accurate last known location, sighting details, animal behavior information, owner contact information, and access instructions available.
  • Client is responsible for securing permission for private property access when required.
  • KC Pet Search & Rescue LLC / KC Pet Search & Rescue is not responsible for inaccessible areas, restricted zones, locked gates, denied access, neighbor disputes, or property owner refusal.

10. Flight Operations & FAA Compliance

  • Drone operations are conducted by an FAA Part 107 Certified Remote Pilot when drone services are used.
  • Flights are performed only where legally permitted and operationally safe.
  • Drone operations may be adjusted, delayed, or canceled due to FAA restrictions, temporary flight restrictions, airspace limitations, weather, visibility, terrain, or safety concerns.

11. Equipment & Technology Limitations

Client understands that all search tools have limitations.
  • Thermal imaging may be affected by temperature, humidity, terrain, vegetation, structures, water, animal size, animal concealment, distance, and background heat.
  • Drones may not be able to fly in all areas or conditions.
  • Traps, cameras, bait, and lures do not guarantee that an animal will return, enter, or remain in the area.
  • Cellular cameras, GPS tools, batteries, mobile networks, apps, and other technology may fail, lose signal, lose power, delay notifications, or provide incomplete data.

12. Trapping, Cameras, Bait & Equipment Use

When trapping, camera monitoring, baiting, or lure placement is used, Client understands and agrees that:
  • Trap success is not guaranteed.
  • Non-target animals may approach or enter a trap.
  • Client may be asked to assist with monitoring, communication, property access, or owner response.
  • Client must not move, tamper with, alter, disable, or remove equipment unless instructed.
  • Client may be responsible for damage, loss, theft, or failure to return equipment caused by misuse, unauthorized movement, negligence, or failure to follow instructions.

13. Owner Participation & No-Chase Policy

Client understands that owner participation may be important to recovery success, especially with timid, fearful, newly lost, or flight-risk animals.
  • Client agrees to follow instructions provided during the recovery effort.
  • Client agrees not to chase, pressure, yell at, or pursue a scared animal unless specifically directed as part of a controlled recovery plan.
  • KC Pet Search & Rescue LLC / KC Pet Search & Rescue is not responsible for outcomes caused by Client, volunteer, neighbor, or third-party actions that conflict with the recommended recovery strategy.

14. Media & Operational Documentation

KC Pet Search & Rescue LLC / KC Pet Search & Rescue may capture video, photos, thermal footage, drone footage, screenshots, maps, case notes, and other operational documentation during service. These materials may be used for:
  • Case documentation
  • Training
  • Operational review
  • Marketing, education, social media, website content, or success stories unless Client requests otherwise in writing
KC Pet Search & Rescue LLC / KC Pet Search & Rescue will make reasonable efforts to avoid sharing sensitive personal information, exact private addresses, or identifying location details without permission.

15. Third Parties, Volunteers & Independent Services

KC Pet Search & Rescue LLC / KC Pet Search & Rescue operates as an independent service provider and is not liable for the actions, omissions, advice, delays, or results of third parties, including but not limited to:
  • Volunteers
  • Neighbors
  • Animal control
  • Shelters or rescues
  • Law enforcement
  • Other searchers, trappers, drone operators, or recovery groups

16. Payment Disputes & Chargebacks

Client agrees to contact KC Pet Search & Rescue LLC / KC Pet Search & Rescue directly regarding any billing concern before initiating a payment dispute or chargeback. Client acknowledges that the service is based on time, deployment, preparation, expertise, equipment, and operational response. A lack of recovery or a change in animal location does not make the service unauthorized or undelivered.

17. Agreement

By completing a booking, purchasing a service, requesting deployment, or checking the agreement box at checkout, Client acknowledges that:
  • Client has read and understands these Terms, Conditions & Operational Policy.
  • Client understands that recovery is not guaranteed.
  • Client accepts the cancellation policy and non-refundable retained amounts.
  • Client accepts all risks associated with animal search, trapping, drone, thermal imaging, and recovery efforts.
  • Client agrees to all policies outlined above.

18. KCPSR 7-Day Lost Cat Camera Loan Program Terms

This Section 18 applies specifically to the KC Pet Search & Rescue 7-Day Lost Cat Camera Loan Program. It works together with the general terms in Sections 1–17 above. Where this Section 18 gives a more specific rule for the camera-loan program, Section 18 controls for that topic. The refundable $100 camera equipment security deposit described below is a separate charge from, and is not governed by, the non-refundable service-retention amounts described in Sections 2 and 3, which apply only to search, trapping, drone, and thermal recovery deployments.

Program details: Free 7-Day Lost Cat Camera Loan

18.1 Program Purpose and Limited Scope

KC Pet Search & Rescue may loan an approved borrower a cellular night-vision motion camera to support an active missing-cat case.
  • This is a limited equipment-loan and monitoring-support program.
  • It is not a camera sale.
  • It is not a giveaway.
  • It is not a guaranteed recovery service.
  • There is no rental charge for the approved standard seven-day period.
  • The $100 payment is a refundable equipment security deposit, not a purchase price and not a rental fee.
  • Ownership of the camera and all accessories remains with KC Pet Search & Rescue or its applicable affiliated owner at all times.

18.2 Subject to Approval and Availability

All camera loans are subject to case review, approval, equipment availability, cellular-service feasibility, pickup availability, geographic service area, and operational discretion.
  • Submitting a request form does not guarantee approval.
  • Paying the deposit without approval does not guarantee that a camera will be released.
  • Cameras may not be immediately available.
  • KC Pet Search & Rescue may decline, delay, cancel, limit, or discontinue a loan when reasonably necessary.
  • Preference may be given to active cases based on urgency, location, suitability, existing demand, equipment condition, and operational needs.
  • KC Pet Search & Rescue does not guarantee a particular camera model, accessory package, cellular carrier, image allowance, or monitoring arrangement.

18.3 Eligibility and Authority

By requesting or accepting a camera loan, the borrower affirms that:
  • They are the missing cat’s owner, or are authorized by the owner, to request the loan.
  • They are at least 18 years old.
  • They can lawfully enter and use the intended deployment location.
  • They have obtained any necessary permission from the property owner, tenant, landlord, HOA, business, or other applicable party.
  • The camera will be used only for the approved missing-cat case.
  • Information supplied to KC Pet Search & Rescue is accurate to the best of their knowledge.

18.4 Pickup and Equipment Checkout

  • Pickup must be coordinated and confirmed with KC Pet Search & Rescue in advance.
  • Cameras are not released until the required agreement and deposit are completed.
  • The borrower may be required to present identification at pickup.
  • An equipment checkout record may list the issued items, such as the camera, antenna, strap, mount, memory card, and battery or power accessories.
  • The borrower should inspect the equipment at pickup and immediately report any visible damage or missing items.
  • Accepting the equipment confirms receipt in the documented condition unless an issue is noted at checkout.

18.5 Seven-Day Loan Period

  • The standard loan period is seven consecutive calendar days.
  • Day one begins on the agreed pickup date.
  • The return date and time should be documented at checkout.
  • Delayed installation, lack of sightings, poor weather, signal problems, nonuse, or failure to receive images does not automatically extend the return deadline.
  • Extensions are valid only when approved by KC Pet Search & Rescue before the original return deadline.
  • Silence, unanswered communication, or continued possession does not constitute approval of an extension.

18.6 $100 Refundable Equipment Security Deposit

A $100 refundable equipment security deposit is required before the camera is released. The full $100 is refunded after the camera and all provided accessories are returned by the agreed date in substantially the same working condition in which they were provided, excluding reasonable wear from approved use.
  • The deposit is not a rental fee.
  • The deposit is not the purchase price of the camera.
  • Paying the deposit does not transfer ownership of the camera or accessories.
  • The full refund is initiated only after the returned equipment has been inspected.
  • Depending on the borrower’s bank or card provider, refunds may take approximately 5–10 business days to appear.
  • KC Pet Search & Rescue absorbs the original card-processing cost when the borrower qualifies for a full refund.

18.7 Deposit Deductions and Additional Responsibility

Some or all of the deposit may be retained for documented:
  • Failure to return the equipment
  • Late return without prior approval
  • Missing accessories
  • Loss or theft
  • Physical, water, moisture, or animal damage
  • Improper mounting
  • Unauthorized opening, disassembly, alteration, or reprogramming
  • Removal or replacement of identifying labels
  • Misuse, or lending or transferring the equipment to another person
  • Use at an unapproved location or for an unapproved purpose
  • Excessive cleaning, repair, reset, recovery, or replacement requirements caused by misuse
If documented repair, recovery, replacement, or missing-accessory costs exceed the security deposit, the borrower may remain responsible for the reasonable additional amount, to the extent permitted by applicable law and any signed equipment agreement covering the loan. Any such additional amount will be reasonable, documented, and tied to actual loss or expense.

18.8 Late or Unreturned Equipment

  • Borrowers must contact KC Pet Search & Rescue before the return deadline when a genuine problem prevents timely return.
  • KC Pet Search & Rescue may demand immediate return when the loan expires, the approved purpose ends, misuse occurs, or another operational need reasonably requires it.
  • KC Pet Search & Rescue may revoke shared camera-platform access when the approved loan period expires, when misuse occurs, when the camera is moved or used without authorization, or when the equipment is not returned as agreed. Revoking shared access does not extend the loan, transfer ownership, or remove the borrower’s responsibility to return the equipment.
  • Continued possession after the deadline does not create a new rental period or transfer ownership.
  • KC Pet Search & Rescue may pursue reasonable recovery costs and lawful remedies for unreturned property.

18.9 Theft, Disappearance, and Third-Party Interference

  • The borrower must take reasonable steps to secure the equipment and should avoid easily stolen, publicly accessible, or unsafe placement.
  • Theft, vandalism, wildlife damage, removal by a property owner, confiscation, or interference by a third party does not automatically eliminate the borrower’s responsibility under this agreement.
  • Any loss, theft, vandalism, confiscation, or disappearance of the equipment must be reported to KC Pet Search & Rescue immediately.
  • KC Pet Search & Rescue may require a police or incident report when equipment is stolen.
  • The borrower must cooperate reasonably with efforts to locate or recover missing equipment.

18.10 Approved and Prohibited Use

The camera may be used only:
  • For the approved missing-cat case
  • At the approved location
  • During the approved loan period
  • In accordance with KC Pet Search & Rescue instructions
  • In a lawful and reasonably secure position
The following are prohibited:
  • Commercial security use or general surveillance
  • Monitoring another person
  • Placement aimed into homes, windows, bedrooms, bathrooms, changing areas, or other locations where privacy is reasonably expected
  • Hunting or wildlife scouting
  • Use for another missing pet without approval
  • Loaning the equipment to another person, or sale, pledge, transfer, or disposal of the equipment
  • Opening, altering, painting, covering sensors, changing settings, replacing cards, changing cellular accounts, removing labels, or attempting repairs
  • Submersion or placement where flooding is reasonably foreseeable
  • Placement on roadways, utility equipment, railroad property, airport property, government property, restricted property, or another person’s property without permission
  • Any illegal, unsafe, harassing, deceptive, or invasive use

18.11 Privacy, Images, and Recording Responsibility

  • The camera may capture images of people, neighbors, workers, vehicles, wildlife, pets, property, or unrelated activity in addition to the missing cat.
  • The borrower is responsible for lawful placement and for avoiding areas where individuals have a reasonable expectation of privacy.
  • The borrower must comply with property rules, landlord requirements, HOA requirements, local rules, and applicable privacy laws.
  • KC Pet Search & Rescue does not authorize unlawful surveillance.
  • Images and video are transmitted through a third-party cellular-camera platform. That platform’s availability, storage, security, delay, and service terms may apply, and no image system can be guaranteed completely uninterrupted or error-free.
  • Both the borrower and KC Pet Search & Rescue may have shared access to view images and video transmitted during the loan period through the camera platform, for the purpose of supporting the missing-cat case.
  • Images and video should be used only for the missing-pet case, equipment support, case documentation, or another purpose expressly authorized by the borrower or required by law.
  • This section does not give KC Pet Search & Rescue ownership of every image captured; it describes shared access to support the case during the loan.

18.12 Cellular Service and Technical Limitations

  • The camera requires adequate cellular coverage. Home Wi-Fi may not be required, but cellular signal is required.
  • Image transmission may be delayed, incomplete, duplicated, missed, or interrupted.
  • Motion detection does not capture every animal or event, and the camera may produce false triggers.
  • Batteries, antennas, memory cards, software, servers, weather, vegetation, placement, heat, cold, moisture, wildlife, signal congestion, and third-party outages may affect performance.
  • Food placed near the camera may attract wildlife or unfamiliar animals.
  • KC Pet Search & Rescue does not guarantee continuous operation, a particular number of images, real-time delivery, detection, identification, location, trapping, or recovery.
  • A technical failure does not automatically establish negligence or create a guaranteed refund beyond the deposit terms in Section 18.6.

18.13 Placement, Installation, and Physical Risks

  • The borrower is responsible for selecting and accessing a lawful placement location unless KC Pet Search & Rescue expressly performs that work.
  • Instructions and placement suggestions are general recovery guidance, not a guarantee of safety or results.
  • The borrower assumes ordinary risks associated with walking, climbing, mounting, removing, checking, or retrieving the equipment.
  • Cameras should not be placed where installation or retrieval requires unsafe climbing, entering water, crossing traffic, confronting animals, trespassing, or exposure to electrical, structural, environmental, or criminal hazards.
  • The borrower must not enter private, restricted, or dangerous property.
  • Children should not install, remove, alter, or handle the equipment without responsible adult supervision.
  • KC Pet Search & Rescue may reject or discontinue an unsafe placement.

18.14 Missing-Cat and Recovery Limitations

  • The camera is only a monitoring tool. It does not capture or contain the cat.
  • A cat may be present without triggering the camera, or may approach from outside its field of view, or may stop returning.
  • Wildlife or other cats may visit the camera’s location.
  • Food, scent, placement, noise, weather, people, traps, and animal behavior may influence results.
  • No sighting, location, capture, survival, return, or recovery is guaranteed.
  • The camera does not replace veterinary care, animal control, law enforcement, humane trapping, thermal search, or a complete recovery plan when those services are needed. Additional recovery services are separate and may involve additional fees and agreements.

18.15 Borrower Conduct and Third Parties

  • The borrower controls their own actions and the actions of family members, neighbors, volunteers, and other helpers.
  • KC Pet Search & Rescue is not responsible for chasing, handling, trapping, confrontation, trespass, injury, property damage, animal behavior, or other conduct by the borrower or third parties.
  • The borrower must not represent themselves as an employee, agent, or authorized representative of KC Pet Search & Rescue, and may not make commitments on behalf of KC Pet Search & Rescue.

18.16 Release, Limitation of Liability, and Indemnification

The release, hold-harmless, limitation-of-liability, and indemnification protections described in Sections 6–8 and 15 above extend, to the fullest extent permitted by applicable law, to claims arising from the camera-loan program, including claims arising from:
  • Borrower installation or removal of the camera
  • Property access or camera placement
  • Privacy or surveillance complaints
  • Images or transmissions, including third-party camera-platform failures
  • Theft, vandalism, confiscation, or animal damage to the equipment
  • Injuries to people or animals, or property damage, connected to the borrower’s use of the equipment
  • Food stations, wildlife, or trap or recovery activity connected to the loan
  • Borrower or volunteer conduct
  • Failure to detect, sight, or recover the missing cat
Nothing in this Section 18 is intended to waive liability for gross negligence, willful misconduct, or any liability that cannot lawfully be waived. This section is marked for professional legal review; see the note at the end of this page.

18.17 Termination and Return Demand

KC Pet Search & Rescue may terminate a camera loan and demand return when:
  • The loan period expires
  • The approved missing-cat case ends
  • The equipment is being misused
  • Safety or privacy concerns arise
  • The borrower provided inaccurate information
  • The equipment is moved without approval
  • The borrower violates this agreement
  • Operational or equipment needs reasonably require return
The borrower must cooperate with reasonable return instructions.

18.18 Acceptance and Incorporation

This Section 18 may be accepted through Gravity Form consent checkboxes, an electronic checkbox, WooCommerce checkout, an electronic signature, a written equipment checkout agreement, a physical signature, or acceptance and possession of the equipment. The camera-specific checkout record, invoice, form submission, product checkout, and these website terms should be read together. KC Pet Search & Rescue does not currently use a separate signed camera equipment checkout agreement for every loan; if one is introduced for a specific loan, the following order of control applies where terms conflict:
  1. A signed camera checkout agreement for that loan, if used
  2. Case-specific written terms provided at pickup, if any
  3. The WooCommerce deposit product terms
  4. These general website Terms
